Agreement to these terms
These Terms of Service (“Terms”) form a binding agreement between you (and, if you act for an organization, that organization) and ScoutingAPI (“ScoutingAPI”, “we”, “us”) governing your use of the ScoutingAPI website, dashboard, App, REST API, MCP server and related services (together, the “Service”). By creating an account, generating an API key, connecting the MCP server, or otherwise using the Service, you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service.
The service
ScoutingAPI is a unified, read-only accommodation-data API. It returns availability, search, listing, price, price-comparison and review data normalized into one schema across platforms such as Airbnb, Booking.com, Vrbo and Google Hotels, over REST and MCP. The data is derived from publicly reachable, non-authenticated pages; ScoutingAPI is a resale and normalization layer and is not affiliated with, endorsed by, or sponsored by any of those platforms.
Accounts & eligibility
- You must be at least 18 (or the age of majority where you live) and able to form a binding contract.
- You must provide accurate account information and verify your email; live credits are not usable until your email is verified.
- You are responsible for all activity under your account and for keeping your credentials confidential. Notify us promptly of any unauthorized use.
- One person or organization may not operate multiple free accounts to multiply free credits, and may not evade caps, rate limits or suspensions.
API keys, tokens & security
Your API keys (scout_live_… / scout_test_…) and OAuth tokens are secrets that authenticate as you and draw on your credit balance. Keep them secret, transmit them only over TLS in the Authorization header, and rotate or revoke them if exposed. You are responsible for usage and charges incurred through your keys and tokens until you revoke them. Do not probe, scan, or attempt to breach the security of the Service, or circumvent authentication, rate limits or metering.
Plans, credits & billing
- The Service is metered in credits. Plans, credit tiers and top-up packs are described on the pricing page and in the docs.
- Failed, empty, blocked and not-found calls are free. You are charged only for successful, non-empty results, per the published tiers.
- Subscription credits reset monthly; top-up credits never expire. Paid plans renew automatically until cancelled. Payments are processed by Stripe.
- Cancellation, downgrades and our refund position are described in the Refund Policy, which forms part of these Terms.
- Fees are exclusive of taxes; you are responsible for applicable taxes other than taxes on our income.
Acceptable use
You agree not to use the Service to:
- Break the law, infringe others’ rights, or violate the terms of the underlying source platforms in your redisplay or resale of the data.
- Re-identify, de-anonymize, harass, or profile individuals (including hosts and reviewers), or combine the data with other sources to do so.
- Rebuild a competing bulk mirror of a platform’s catalog, or resell raw data in a way that violates a source platform’s terms.
- Exceed, evade or automate around plan limits, rate limits, credit metering, or abuse controls; share, farm or resell free-tier credits.
- Interfere with or disrupt the Service or its infrastructure, or use it to distribute malware or conduct denial-of-service activity.
- Misrepresent your identity, or use the Service on behalf of a sanctioned party or in a sanctioned territory.
We may act on misuse
Your responsibility for the data
ScoutingAPI provides data; how you use it is your responsibility. You are an independent controller of any personal data you receive and must comply with all applicable laws (including data-protection and consumer-protection law) in your own product. Where you redisplay listing content, you are responsible for appropriate attribution and for respecting the rights and terms attached to that content. You are responsible for obtaining any consents your own use requires.
Source data & attribution
Every normalized record carries the source platform and a canonical source url so the original listing can be attributed and linked. We pass through source image URLs and never rehost photographs. Facts such as prices, dates and availability are provided “as sourced” and can change or be unavailable; a platform or listing may be temporarily unavailable, in which case that leg returns a typed unavailable/partial result and is not charged.
Intellectual property
The Service, including the unified schema, documentation, SDKs, website and brand, is owned by ScoutingAPI and protected by intellectual-property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service and its outputs to build and operate your own application. We reserve all rights not expressly granted. Underlying listing content, reviews and photographs remain the property of their respective owners or the source platforms; nothing here transfers ownership of that content to you.
Takedowns & DMCA
We respect intellectual-property and privacy rights and respond to valid notices. If you believe content returned by the Service infringes your copyright, or you are an individual seeking removal of your data, contact dmca@scoutingapi.com (copyright) or privacy@scoutingapi.com (personal data). On a valid notice we can purge the specific cached rows and suppress the affected source or listing from future fetches.
Disclaimers
The Service and all data are provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Because the data is sourced from third-party public pages, we do not warrant that it is accurate, complete, current, or uninterrupted, and we are not responsible for decisions you make based on it. Any committed uptime commitment and associated service credits, where offered, are stated in your plan or order form and are your sole remedy for downtime.
Limitation of liability
To the maximum extent permitted by law, ScoutingAPI and its suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or relating to the Service, even if advised of the possibility. Our total aggregate liability for all claims relating to the Service is limited to the greater of (a) the amounts you paid us for the Service in the three months before the event giving rise to the claim, or (b) USD 100. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
Indemnification
You will defend, indemnify and hold harmless ScoutingAPI from and against claims, damages, liabilities, and reasonable costs (including legal fees) arising out of your use of the Service, your application, your redisplay or resale of the data, or your breach of these Terms or of applicable law.
Suspension & termination
- You may stop using the Service and close your account at any time from the dashboard.
- We may suspend or terminate access, with or without notice, if you breach these Terms (including Acceptable Use), fail to pay, create risk or legal exposure for us or the source platforms, or if we are required to by law. Where practical and appropriate, we will give notice and an opportunity to cure.
- On termination your license ends and you must stop using the Service. Sections that by their nature should survive (including intellectual property, disclaimers, liability limits, indemnification, and governing law) survive termination. Refund treatment on termination is governed by the Refund Policy.
Changes
We may modify the Service or these Terms. For material changes to these Terms we will update the effective date above and, where required, notify account holders. Deprecations of API surfaces are communicated per our published deprecation policy. Continued use after a change takes effect means you accept the revised Terms.
Governing law & disputes
These Terms are governed by the laws applicable to ScoutingAPI’s place of establishment, without regard to conflict-of-laws rules, and the parties submit to the courts with jurisdiction there, except where mandatory local consumer law provides otherwise. If any provision is held unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver.
